When a Private Sale is a Bad Idea

✔   The buyer may be prohibited from owning firearms.

✔   The buyer lives outside of Florida.

✔   The firearm is an NFA or other unusual firearm.

✔   Ownership or estate authority is unclear.

What Responsible Florida Gun Sellers Should Do

1.  Confirm Florida residency:

Ensure both you and the buyer are Florida residents.

If the buyer is not a Florida resident, follow the interstate firearm transfer rules instead.

2.  Verify the buyer seems legally eligible

Do not sell if you suspect the buyer cannot legally own a firearm.

3.  Prepare a bill of sale and firearm details

Include make, model, serial number, date , and sale amount.

Frequently Asked Questions

Do I need an FFL to sell a gun privately in Florida?

Not always. Florida law does not generally require two unlicensed Florida residents to use an FFL for every lawful private firearm sale. However, federal and state restrictions still apply, including rules concerning prohibited persons and interstate transfers. Can I sell a gun to someone in another state?

Generally, you should not directly transfer a firearm to an unlicensed person who resides in another state. Is a bill of sale required for a private gun sale in Florida?

Florida does not generally require a specific state firearm bill of sale for an ordinary private transaction between lawful Florida residents. Even so, keeping a written record of the sale is a prudent practice. What if I am not sure the buyer can legally own a gun?

Do not complete the sale. Federal law prohibits transferring a firearm when you know or have reasonable cause to believe the recipient is prohibited from receiving or possessing firearms. Do private gun sales require a background check in Florida?

​A routine private sale between two unlicensed Florida residents is different from a dealer transfer and does not ordinarily use the FDLE dealer background-check system. When an FFL transfers a firearm to an unlicensed person in Florida, Florida law requires the applicable background check before the firearm may be transferred.  Florida Gun Transfer Background Checks

Can I privately sell an inherited firearm?

Potentially, but first make sure you actually have legal authority to sell it. Estate firearms may be controlled by a personal representative, executor, trustee, probate proceeding, or other ownership arrangement before they can be distributed or sold.

Extra rules can also apply if the intended buyer lives outside Florida or if the collection contains NFA-regulated firearms. When estate ownership or authority is unclear, the firearm should not be sold until the issue has been resolved.
